1. Scope of Application

These General Terms and Conditions apply to all orders placed through our online shop at www.amilior.de. The offer is directed at consumers within the meaning of § 13 BGB (German Civil Code) as well as entrepreneurs within the meaning of § 14 BGB.

We exclusively offer furniture, in particular modular sofas and accessories (hereinafter "goods"), for purchase. Deviating conditions of the customer apply only if we have expressly agreed to them in writing.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an non-binding invitation to place an order (invitatio ad offerendum).

By clicking the "Buy Now" button, the customer submits a binding offer to conclude a purchase contract. The confirmation of receipt of the order is sent automatically by email immediately after submission and does not yet constitute acceptance of the offer. The purchase contract is concluded only upon dispatch of an explicit order acceptance confirmation or upon delivery of the goods.

Since many of our sofas are manufactured according to individual customer configurations (module selection, fabric, color), we reserve the right to refuse orders if individual configurations or materials are unavailable. In this case, the customer will be informed immediately, and any payments already made will be fully refunded.


4. Prices and Payment

All prices are in euros and include the statutory value-added tax. Shipping costs are listed separately and clearly indicated during the order process.

Payment is made using the payment methods offered in the shop (e.g., credit card, PayPal, Klarna, and other payment service providers). For advance payment, the amount must be transferred to the specified account within 7 working days. If this deadline is exceeded without payment, we are entitled to withdraw from the contract.


4a. Purchase on Account

The "Purchase on Account" payment method is a voluntary additional service and is only offered under certain conditions. The customer has no right to this payment method. Its availability may depend on an internal credit check, the order value, and other criteria. The invoice amount is due within 14 days of receipt of the goods, unless a different payment period has been agreed upon in writing.


5. Delivery and Delivery Time

Delivery is made to the delivery address provided by the customer within Germany. Deliveries abroad are only possible after prior arrangement.

Since our sofas and modules are predominantly custom-made to order, the delivery time is generally 6 to 8 weeks from order acceptance and receipt of payment. For stock items, the delivery time may be shorter; a different delivery time is indicated in the respective product offer.

We deliver with a forwarding partner. The goods are delivered to the front door or, upon request and special agreement, to the installation location. The customer will be informed in advance by email or SMS about the estimated delivery date and will receive a time window of at least 3 hours.

If agreed delivery dates are exceeded by more than 4 weeks for reasons for which we are responsible, the customer is entitled to withdraw from the contract. Any payments already made will be fully refunded in this case.


6. Right of Withdrawal

Consumers generally have a statutory right of withdrawal according to §§ 312g, 355 BGB. The withdrawal period is 14 days from the day on which the customer or a third party named by them took possession of the goods.

The right of withdrawal is excluded according to § 312g Abs. 2 Nr. 1 BGB, insofar as the ordered modules or upholstery fabrics were manufactured according to individual customer specifications (configuration, fabric, color) and cannot be used for another customer. We expressly point out this exclusion during the order process before the order is placed.

For non-individualized stock items (e.g., standard modules in standard colors), the statutory right of withdrawal applies without restriction. The return shipping of sofa modules is at the customer's expense; we will charge for pick-up costs upon request. To exercise the right of withdrawal, a clear declaration by email to support@amilior.de is sufficient.


6a. Contract Adjustments by the Seller

The seller is entitled to withdraw from the contract for objectively justified reasons, in particular in the event of pricing errors, unavailability of materials or modules, payment problems, justified suspicion of fraud, or violations of these GTC. Any payments already made will be refunded immediately, at the latest within 14 days, in this case.


7. Transport Damages

If goods are delivered with obvious transport damage, the customer is requested to complain about such defects immediately to the delivery person and to inform us as soon as possible by email (support@amilior.de). Please document damages with photos. We will re-deliver damaged modules free of charge. A return is generally not necessary. Failure to comply with this deadline does not affect your statutory warranty rights.


8. Retention of Title

The delivered goods remain the property of the seller until full payment of the purchase price, including all ancillary costs (retention of title). The customer is not entitled to pledge, transfer ownership of, or otherwise encumber the goods subject to retention of title before the purchase price has been paid in full.


9. Warranty and Liability for Defects

The statutory warranty rights apply. The statutory warranty period is 2 years from the delivery of the goods. In addition, we grant the following voluntary guarantees:

  • Frame and connecting elements: 10-year warranty against material and manufacturing defects under normal use
  • Foam and suspension: 5-year warranty
  • Upholstery fabrics and seams: 2-year warranty

Excluded from the warranty are normal wear and tear, willful damage, improper cleaning, and damage due to excessive strain. To assert a warranty claim, photos of the defect and the order number must be sent to support@amilior.de.


10. Liability

The seller is liable without limitation for intent and gross negligence, as well as for culpable injury to life, body, or health. In the event of simple negligence, the seller is liable only for the breach of essential contractual obligations (cardinal obligations) and limited to foreseeable, typical contractual damage. Further liability is excluded.


11. Product Safety and Standards

All Amilior products comply with applicable European safety standards for furniture. The materials used meet the requirements of EU Regulation 2023/988 on general product safety. Technical product data and care instructions can be found in the respective product description and the enclosed assembly instructions.


12. Dispute Resolution

The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr

We are not obligated and unwilling to participate in dispute resolution proceedings before a consumer arbitration board.


13. Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is - as far as legally permissible - the owner's registered office. Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by the legally valid provision closest to it.
